Paul
M. Hubbard is a principal of the firm. The principal focus of
Paul’s practice is real estate. Within that broad category,
Paul advises and assists lending clients with loan structuring
and all required loan documentation, including loan agreements
and their related security documents such as mortgages, as well
as title insurance with loan disbursement features. Paul also
handles real estate foreclosures, principally commercial, and
the creation and enforcement of other real estate rights, such
as installment land contracts and mechanic’s liens.
Paul
also advises and assists real estate developers with: tax-deferred
exchanges; tax increment financing; the creation and implementation
of acquisition agreements, options, and development entities;
the creation of agreements for development of the properties of
others, including construction, project-management, leasing, marketing,
brokering and financing, as well as related agreements with co-venturers
and investors and others who are involved in real estate. Paul
also acts as a consultant to clients and often to other attorneys,
on many types of complex real estate problems.
Paul
is listed as one of the three real property attorneys rated most
qualified in Cass County, North Dakota by Best Lawyers in America,
which rates attorneys by county, and is listed as one of the three
first-tier real property attorneys rated most qualified in North
Dakota by Chambers Legal Directory, which rates attorneys by state.
Paul
earned a Bachelor of Arts degree in English from Moorhead State
University in 1966 and received his Juris Doctor, cum laude, from
the University of South Dakota in 1973, where he was an editor
of the Law Review. He has been with the firm since 1973.
Paul
is licensed to practice law in the state and federal courts in
North Dakota and Minnesota and is a member of the North Dakota
and Minnesota State Bar Associations. He is also a certified Minnesota
Real Property Specialist. He has been president of the Cass County
Bar Association, and Chairman of the Real Property Section of
the State Bar Association, as well as a continuing legal education
instructor and legislative draftsman.
